1. PAYMENTS
    No deposits are required for golf trips. Each Customer is required to pay NYGT the full cost of the trip 30 days or more before the trip. Group leaders are free to pay the full cost of the trip, but most prefer to have each Customer pay individually on NYGT’s secure online payment form. NYGT accepts MasterCard, VISA and checks or money orders made payable to NYGT.
  2. CANCELLATIONS & REFUNDS
    (a) Cancellations by Customer. Individual Customers may cancel 48 hours before the trip for a full refund. If the cancellation is less than 48 hours, Customers will receive a 50% refund. Entire golf parties may cancel 72 hours before the trip for a full refund. If the cancellation is less than 72 hours, each Customer will receive a 50% refund. However, in each case, a particular golf course, hotel, or other provider’s cancellation policy supersedes this NYGT policy. For example, if a hotel requires 10 days notice for a full refund, this policy will be in effect for the trip. For double-occupancy rooms, the group leader is responsible for the balance of the lodging cost if a single Customer cancels. The group leader has the option to pay the balance himself/herself, spread the balance among the other Customer in the group, or have the Customer in a single occupancy room pay the balance. The group leader will inform NYGT before the trip how they intend to pay the balance and make arrangements with NYGT to do so.(b) Substitution of Services/Cancellation by NYGT. NYGT reserves the right to substitute courses and accommodations other than those first agreed upon due to availability or other issues. NYGT will make every good faith effort to provide alternate options that are most suitable to the group leader. With the group leader’s agreement, NYGT will modify the trip to include the alternate course(s) and accommodations, making all the necessary arrangements and communicating them back to the group leader. Any changes to the cost of the trip will be communicated to the group leader at the time the options are presented. Customer has the option to refuse these changes and cancel the trip without penalty and receive a full refund. If comparable services or accommodations cannot be supplied due to causes beyond our control, there will be no liability or responsibility by NYGT. In the event complete cancellation is required by NYGT, NYGT’s only liability will be to refund all monies paid without interest.

    (c) Weather/Rain. If a round of golf is completely rained out due to weather and the golf course does not charge NYGT, NYGT will refund each Customer the full cost of the round. If a round of golf is partially rained out, the Customers should be sure to receive rain checks from the course. These can be used at a later date if the group wishes, or NYGT may purchase them for 50% of their face value. There is no refund for a partial rain-out.

  3. LIMITATION AND WAIVER OF LIABILITY
    By embarking upon his/her travel, the Customer voluntarily assumes all risks. NYGT books lodging and golf course reservations and issues all vouchers for the customer only upon the express condition that NYGT and its employees, officers, directors or any individual representatives shall not be held liable for, and Customer shall indemnify NYGT from, any and all claims, losses, personal injury, damages, costs, expenses, delays or loss of enjoyment of any nature or which may be occasioned by acts, omissions or negligence of the persons or companies rendering any of the services, or by any Customer, and Customer agrees not to bring any action against NYGT arising therefrom. NYGT shall not be held responsible or liable for losses or additional expenses due to changes or delays in air, road, or other services, sickness, labor disputes, war or threat of war, weather or other causes. NYGT shall not be liable for any additional expenses of any kind, nor damage to hotel or condo properties, and the Customer hereby expressly waives any claims for loss, damage or injury of any kind against NYGT. NYGT cannot guarantee weather conditions nor can NYGT be responsible for any shut down, in whole or in part of the operation of the facility (golf course, hotel or other supplier), whether they be caused by weather or for any other reason.

IN ANY AND ALL INSTANCES, NYGT’S LIABILITY TO CUSTOMER IS EXPRESSLY LIMITED TO A REFUND OF ANY FEES PAID TO NYGT BY CUSTOMER, AND SHALL SPECIFICALLY EXCLUDE (WITHOUT LIMIT) ANY OTHER ACTUAL DAMAGES, CONSEQUENTIAL, INDIRECT, OR SPECIAL DAMAGES WHATSOEVER, FROM ANY CAUSE OF ACTION.

The parties agree that exclusive venue for any action in any way arising out of this Agreement is any court of competent jurisdiction in Monroe County, New York, and that New York law shall apply without reference to its conflicts of laws principles.
